1. Agreement to Terms

By downloading, installing, or using Ascend ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms form a legal agreement between you and Venture Hills LLC ("we", "us", "our"), the developer of Ascend, operating at hills-dev.com.

2. Description of Service

Ascend is a habit tracking and personal development app that includes:

• Daily habit tracking with streaks and XP rewards
• PRISM attribute system (Time Management, Focus, Health, Confidence, Consistency)
• Community posts, likes, and comments
• Private journaling with mood tracking
• AI Coach for personalized habit advice
• Rank progression system (Iron through Ascendant)

Some features require a paid subscription ("Ascend Premium"). Free features are available without a subscription.

3. Eligibility

You must be at least 13 years old to use Ascend. By using the App, you confirm that you meet this requirement.

If you are between 13 and 18 years old, you confirm that your parent or guardian has reviewed and agreed to these Terms on your behalf.

4. Account Registration

To use Ascend, you must create an account with a valid email address.

You are responsible for:

• Keeping your password secure and confidential
• All activity that occurs under your account
• Notifying us immediately of any unauthorized use at support@hills-dev.com

We reserve the right to terminate accounts that violate these Terms.

5. Subscriptions and Payments

Free Tier

Core features are available at no cost.

Ascend Premium

Premium features require a paid subscription managed through Apple's App Store in-app purchase system.

• Billing: Subscriptions are billed through your Apple ID account
• Auto-renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period
• Cancellation: Cancel anytime in your iPhone Settings → Apple ID → Subscriptions
• Refunds: All refund requests are handled by Apple per their App Store refund policy
• Price changes: We'll notify you of price changes at least 30 days in advance

We do not process payments directly. All purchases are handled by Apple and subject to Apple's Terms of Service.

6. User Content

Your Content

You retain ownership of all content you create in Ascend, including posts, journal entries, habit names, and profile information ("User Content").

By using Ascend, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your User Content solely to provide the App's services to you.

Content Standards

You agree NOT to post content that:

• Is illegal, harmful, threatening, abusive, or harassing
• Infringes on anyone's intellectual property rights
• Contains spam, malware, or deceptive content
• Involves the solicitation of personal information from minors
• Violates any person's privacy or personal rights

Enforcement

We reserve the right to remove content that violates these standards and to suspend or terminate accounts of repeat offenders.

7. Community Guidelines

Ascend's community features are intended to be supportive and positive. You agree to:

• Be respectful to other users
• Not impersonate other users or real people
• Not post false or misleading information
• Not use the community to advertise or promote external products/services without permission
• Not harass, bully, or intimidate other users

Violations may result in content removal, account suspension, or permanent ban.

8. Prohibited Uses

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use automated scripts or bots to access the App
• Attempt to gain unauthorized access to any part of our systems
• Use the App for any illegal purpose
• Copy, modify, or distribute the App or its content without permission
• Remove any copyright, trademark, or proprietary notices
• Use the App to collect other users' information without consent

9. Intellectual Property

Our Property

Ascend, including its design, code, logos, and all original content, is owned by Venture Hills LLC and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, or distribute any part of the App without written permission.

Third-Party Property

The App may display content from third-party services. That content remains the property of the respective owners.

10. Privacy

Your use of Ascend is also governed by our Privacy Policy, available at ascend.hills-dev.com/privacy. By using the App, you agree to our Privacy Policy.

11. AI Coach

The AI Coach feature is powered by OpenAI's API. By using AI Coach, you agree that:

• Conversations may be processed by OpenAI per their terms
• AI responses are for informational and motivational purposes only
• AI Coach is not a substitute for professional medical, psychological, or fitness advice
• We are not responsible for decisions you make based on AI Coach responses
• We may implement usage limits to ensure fair access

12. Creator Affiliate Program

If you qualify as a creator and participate in the Creator Affiliate Program:

Program Overview

• You may generate referral links in Ascend that credit you when someone installs the app via your link
• Commissions are calculated based on installation attribution via AppsFlyer
• Commissions are paid monthly through a payment method to be specified (Stripe or other processor)

Creator Responsibilities

• You agree not to use fraudulent methods to generate installs (fake clicks, bot traffic, etc.)
• You agree to follow all community guidelines and not spam or mislead users with referral links
• You will not impersonate other users or services to promote your referral link
• You will not use misleading marketing or false claims about Ascend features

Commission Changes

• Commission rates are set by us and may change at any time with 30 days' notice
• We reserve the right to suspend or terminate your creator status if you violate these terms
• We reserve the right to not pay commissions if we detect fraudulent activity

Separate Terms

Your participation in the Creator Affiliate Program may be subject to a separate Affiliate Agreement. In case of conflict, the Affiliate Agreement takes precedence for affiliate-specific terms.

13. Disclaimers

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY OR COMPLETENESS OF CONTENT
• UNINTERRUPTED OR ERROR-FREE SERVICE

We do not guarantee that the App will always be available, bug-free, or that data will never be lost.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, or consequential damages
• Loss of data or profits
• Damages arising from your use of or inability to use the App
• Any content posted by other users

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months prior to the claim.

15. Indemnification

You agree to indemnify and hold harmless Venture Hills LLC from any claims, damages, or expenses (including reasonable legal fees) arising from:

• Your use of the App
• Your User Content
• Your violation of these Terms
• Your violation of any third party's rights

16. Termination

We may suspend or terminate your account at any time for violation of these Terms. You may delete your account at any time through Settings → Delete Account.

Upon termination:

• Your access to the App will cease
• Your data will be deleted per our Privacy Policy
• Provisions of these Terms that should survive termination will remain in effect

17. Changes to Terms

We may update these Terms from time to time. We'll notify you of material changes through the App or via email. Continued use of Ascend after changes take effect constitutes acceptance of the updated Terms.

18. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the United States.
